If President Joe Biden did something illegal regarding the current classified document matter, I want him prosecuted to the fullest extent of the law. Unlike the MAGA cult, which will never accept such a fate for their dear leader, we progressives should and must accept such an outcome. Doing otherwise only puts us in the same boat as them. And that is not a place I want to inhabit.

As the disgraced 45th president most famously proclaimed, he could shoot someone on 5th Avenue, and his people would still love and support him. Unfortunately, that statement is not a bunch of BS like most of what he says is. He spoke the truth, for once.

I, for one, am not the kind of person with Biden flags waving in front of my house. Nor do I have pictures of him transposed onto the body of a superhero. It’s pretty simple: I proudly voted for Joe Biden and would do it again in a heartbeat. But that’s where it ends. He’s my president – not my savior and hero who can do no wrong.

As you may have heard, a handful of classified documents were found at various places in the Biden orbit. Some of the sites mentioned are his home, think tank center, and garage. Supposedly they are from his time as Vice-President under Barrack Obama. Attorney General Merrick Garland has appointed a special counsel to investigate the matter – A Trump appointee.

At first, I thought it was unwise for Garland to do this. But I’ve changed my opinion. In reality, he had no other choice. Garland is a cautious guy who tries to maintain his independence from the executive branch. Again, MAGA world wouldn’t support Garland’s action even if he’d appointed Trump himself. However, the rest of America should be confident that whatever comes out of the investigation will have some modicum of fairness.

I do not think that Biden violated the law. I doubt they’ll find wrongdoing, with the most likely outcome being that the documents were mishandled. Reckless and sloppy? Yes. Illegal? I doubt it. For it to be unlawful, the main factor to consider is the intent of the person who had the documents in their possession. Did he obstruct law enforcement, or was he cooperative?

The intent of the parties involved separates the Trump documents case from the Biden one. These cases are different, at least the facts as we presently know them to be. From the beginning, the former president has put roadblock after roadblock in front of investigators. He’s obstructed and lied throughout the ordeal. He even found an unqualified judge that he appointed to delay the case further. Luckily that judge was smacked down by other Trump-appointed judges.

So yes, the two cases are vastly different. But now we have two special counsels trying to get to the bottom of what occurred. And that brings me to an inconvenient truth that may upset some of my fellow progressives. I’m pissed at Joe Biden, and I hope you are too.

How could he let this happen? Maybe the documents are where they are because the folks in charge of the transfer during the Obama-Biden transition in 2017 screwed up. Let’s hope that’s the reason.

But what frustrates me the most, however, is what’s occurred in the last several months. Why, for instance, was a search of all Biden facilities or residences not conducted immediately after the Trump case became known to the public? His closest advisors and lawyers would have suggested such a thing at the time, right? We do not know what discussions were going on behind closed doors, but at the very least, an extensive search should have been considered.

Equally frustrating, though, is what the discovery of the Biden documents has meant to the ongoing investigation of the disgraced former president. Now, instead of howling and screaming at how badly everyone treats him, which he does daily, he and the rest of MAGA world can exploit the matter to their heart’s content. Now it looks like Biden is no better than the former president regarding classified documents. At least, that’s what the GOP wants everyone to think.

Fair and balanced folks know the difference, of course. By all accounts, Biden and his team are cooperating with federal authorities – unlike the guy in Mar-a-Lago. And it also appears the number of documents found in Trump’s possession far outnumber those found in Biden’s. But it doesn’t matter in the right-wing world. To them, even a slight similarity, in this case, is enough to make it equal. It’s a disingenuous take. But it’s precisely what they will do.

And for that, I must hold Biden responsible for this mess. In the long run, I’m confident he’ll be exonerated. But, as I said in this post’s opening, he must be held accountable if they find something illegal. To say otherwise puts me squarely with the right-wing zealots who kiss the ring of Trump as often as they can.

If, as progressives, we want credibility and proclaim to believe in the rule of law, we must accept the consequences, whatever they may be. I refuse to do as they do. I will not succumb to my decades-long loyalty to the Democratic Party. If a president or former president does something illegal, they must throw the damn book at him, regardless of political affiliation.

So now we’re about to be subjected to the rantings and ravings of the lunatic right-wing, especially those in the House of Representatives, who are in the majority. To say they’re salivating at the chance at show investigations and performance theater red meat for MAGA world is an enormous understatement.

Mr. President, did you have to make it easy for them?

Sigh.

  1. Great post! Like you, I do not believe that these files were taken maliciously or under the radar. I honestly think that people packed up his office and the files where not handled correctly by the aides that emptied his office for the next VP.

    If I could criticize anything, it would have been for Biden to double-check their work and for the aides to be given better directions when packing up the office. I do not feel like there is a criminal intent here.

    Unfortunately, I also think that President Biden is an easy target for the MAGA cult…especially those with any amount of power. I do not want to engage in conspiracy theories, but this is all just very convenient to take the eye off of Orange #45.

I suppose my biggest frustration, as I alluded to in the post, is the simple fact that this gives the disgraced president a gift, of sorts.   2. As a 26+ year Independent, I do not care WHO or what POTUS gets caught doing/committing illegal, unethical behavior while in office or out. Period. In my humble opinion, “no one, not even the U.S. President is EVER above the law!” Once we set the precedent of this double-standard (or triple?) with Richard Nixon, We the People, our Congress, and our DOJ have increasingly backslid downward from this highly virtuous principle of Constitutional law.

    But obviously, once O.J. Simpson also went scot-free for double homicide, more precedents were set. 🤦‍♂️ If you are wealthy enough, then you can get away with planning and inciting an insurrection against the U.S. (and your sworn oath of office!) or even double murder.

    I’m quite sure that our Core Founding Fathers are deeply disturbed by what they see their hard-fought & sacrificed-much… nation has slipped to and are not rolling in their graves, but instead are incensed & flippin’ tha EFF out!!! 😞

  3. There are some differences, not in the act itself, taking classified documents is the same no matter which party does it. The thing I’m concerned about is how the two cases are treated by everyone. With Trump, it was guilty right away, no waiting to see about anything. With biden, most people are saying “let’s wait and see how this shakes out”. Why the difference in attitude and approach/
    With trump, there was a predawn raid and agents even went through his wife’s clothes closet. biden took documents so why no raid? why no going through the first ladies clothes closet/
    This exemplifies the very complaint that a lot of liberals seem to have about a two tiered justice system but they don’t give voice to that complaint when it involves politicians of their favored party.
    At least you’re a bit fairer about this than some other bloggers we follow so that’s refreshing anyway.

  5. This is of course Jeff is the correct course to take. Sloppy, careless call it what you will is equally dangerous (think of the analogy with a driver). This should be looked into with the thoroughness it requires.
    When it comes to the Right, they of course will tie themselves up in knots. They want the Wrath of God to descend on Biden, but made and still make excuses for Trump. If they were honest and patriotic they would have least said to Trump ‘Donald. We love you, but don’t you think you’re pushing your luck?’

I also consider that then-VP Biden’s son, Beau, had died less than two years prior (May 2015), the main reason Joe didn’t run in the 2016 election, and no doubt a review of the papers packed up by his staff was not high on his priority list. Today I read that Biden is being asked for a ‘visitor log’ for his personal residence in Delaware for the time he was out of office … who keeps a visitor log in their private home??? It’s not apples to apples here, but as Jonathan Capehart said, it is “apples to basketballs”. I’m sick of all the game playing … when do we get down to the serious business of governance? Sigh.

    1. Thanks Jill. That IS the question, isn’t it? When will they get serious? The answer at this point is never. They only run to obtain power. I really believe that’s the vast majority of the GOP. They’d rather express fake outrage at the Biden docs and ask for his visitor logs, but simply look away at what’s going on down in Mar-a-Lago. And, if I’m not mistaken, wasn’t there a Chinese spy down there early on in Trump’s presidency? And not too long ago there was a lady claiming to be a member of the Rothchild family hanging out there golfing/mingling with Trump and his minions. That particular lady was from, like Kazakstan, if I’m not mistaken. And very shady. But sure, let’s ask for Biden’s visitor logs. UGHHHH. They are NOT serious people Jill!

        it may surprise you to know that there are some other people besides the democrats that call out the conflicts of interests which were many when trump was in office.

        how about how he gave Wilber Ross a position in his cabinet after being bailed out by him in the 90’s. I didn’t hear a lot of republicans talk about that either but there were some content creaters who pointed it out. Conflicts of interest are horrible no matter which party is involved with them and I agree that more republicans should call out their own, it would give more credibility to it when they rightfully call the democrats out on the same thing.

They are jackals, interested only in their own power and wealth. Some days I feel that we are already living in an autocracy, we just don’t realize it yet. How I would love to see the people of this nation rise up against the hypocrisy, stage a tax revolution or massive protests every day. But alas, we will just keep sitting here wringing our hands. And on another topic, a question … my friend Nan tells me that there is once more a push for certain counties in Oregon to become part of Idaho. I remember this issue from some time ago, but I thought it was DOA. Is your county one that would be directly affected?

I do know there was another push to carve out a 51st state, and call it The State of Jefferson. I wrote about it a couple of years ago. These folks are nuts. The possibility of it happening is pretty remote Jill. But these are the kind of folks who now dominate rural America. And was, and is, exploited by the MAGA King for his own self-gratifying narcissistic ways. Sigh. We’re in such a rabbit hole, are we not?

We could end up with 100 or more states! The next logical step after that is to divide the nation into two, but that’s way easier said than done.         Of course the fact that Biden also had documents is unacceptable. But the point most folk recognize is that he didn’t try to stop anyone from accessing them and returning them to their proper location. Also, it appears he didn’t know about them. Whether that’s a political excuse or not, I don’t know — but we DO know that Trump was well aware that he had them in his possession.

      16. Scott, there are clear differences in these cases, as I pointed out in my post. I also said, and you agreed, that politicians must be held to account.
        But here’s the thing. Have you seen anything on social media from Biden berating the Trump appointee who is looking into the doc case? The answer is an emphatic no. Have you seen the former president lambast and call Jack Smith, the guy investigating him, a radical leftist democrat who hates him? The answer is an emphatic yes.
        Of the two, which one is acting guilty, and which one isn’t it? I think you know the answer.
        While you love to ‘both sides’ everything, I for one will not. One side of this equation is a corrupt and dangerous individual who needs his ass thrown in prison. And Biden isn’t that guy. Thanks

      18. More than a few times of late I’ve wondered if in the long run, it would have been better to let the South secede back in the 1860s and not fight a war to reunite the nation. Florida … I don’t even see it as part of the U.S. anymore, with the book banning, anti-LGBTQ phobia, refusal to allow African-American history to be taught. DeSantis and his minions remind me more of the Taliban than of democratic government. Texas is no better, nor is Arkansas. As I was just telling Andrea in another comment, I cannot even begin to predict what the next 10 years holds for this nation.

      22. We needed to address the hypocrisy when the nation was formed. We have never adequately addressed slavery, then Jim Crow, and discriminatory laws and policies to allow us to move forward in any meaningful way. The Civil War could have been avoided had we allowed the country to evolve in an equitable manner.

        If we allowed secession slavery would have continued even longer. That was not a viable solution for the country. Talk of secession now is bullshit and posturing. While there is growing ignorance and misinformation weakening this country, those in power on both sides are driven by greed and power funded by big business. Those businesses must be brought under control and the average American needs to see through the divide and conquer strategy. Most of my neighbors are not my enemies.

  7. I’m so disappointed and disgusted. I’m beginning to think all of them are morons, or think they’re above the law. And when does the Democratic party plan to find a successor to Biden? After the 2024 election is lost to the likes of DeSantis? Last two elections I had to vote for Hillary, who I can’t stand, but feared the alternative, and Biden who is hardly visionary or inspirational or transformational. The whole political landscape really sucks! I don’t even have a Ralph Nader alternative.

That said, Biden seems to be leaning in the direction of running. If he does, I will vote for him 100%. We simply cannot afford to have another radical right president.       3. I will admit that I am baffled by Biden’s decision. He should be judged on his abilities and record, not his age, but I will admit that I find it hard to look beyond his age. Of course, the same is true of Trump, who will be squarely in his mid-seventies by the time of the next election.

        I think the Democrats need to look to younger blood, with new ideas that are a little less embedded in decades of political establishment. Kamala Harris could fill that role.

        The Republicans need to move away from their extremism. I know that ironically he was an older candidate, but John McCain often struck me as the last of the truly good Republicans, even if I’m sure I’d have disagreed with a lot of his policies.

      4. As someone speaking from the box seat of life’s stadium, I have considerable reservations about Biden running again. (I discussed this on my own blog.) IOW, I’m familiar with many of the experiences of aging … and I truly feel that his decision was not a wise one. But “fame” and fortune is difficult to turn down at any age. No, I’m not saying that’s his motivation, but at “ground level,” I do tend to feel it plays a role.

        In any event, if nothing else, the debates will be interesting.

      5. I’m hoping Biden’s decision is more about who the other side is going to nominate. I mean, let’s face it, Trump is the most likely candidate for him. And it doesn’t matter if he’s under multiple indictments. (How ridiculous is that?) Biden probably feels as if he’s the only one that could defeat him. I think and hope that’s his main motivation.

        Now that he’s announced his intention to run, I will be all in on him. There is NO other choice. A GOP candidate, whether it’s Trump, or someone else, is out of the question for me.
        Yes, I thought McCain was a pretty decent guy. And I think Mitt Romney kind of falls into that category as well. But Romney, and any other Republican like him are simply shunned by the party. They aren’t extreme enough. And that, my friend, is sad.

      3. I appreciate opposite viewpoints. As long as folks aren’t rude are threatening, they’re always welcome here. I relish the debate.
        To that end, it appears Justice knew about the documents before the mid-terms. I assume they adhered to the long-standing Justice Dept. rule that they do not comment or indict anyone when it’s within 30-60 days of an election. That’s my understanding. Do I agree with that rule? I’m not sure to be honest. James Comey certainly did not adhere to it a few weeks before the 2016 election and many of us on the left were pissed about that. I think Merrick Garland is a fair guy. I do think he values his independence from the Executive and Legislative branches. I’m fairly sure that’s the reason this didn’t come out before the mid-terms. I’m sure the GOP controlled House will try and get to the bottom of it. We shall see. Thanks for weighing in.

What I have an issue with is how the federal government is even involved in the matter. Roe V. Wade being overturned I am in favor of, as the matter should be at the discretion of the states, even the individuals to decide.

Brookingslib, here is another example of hypocrisy: Hillary Clinton deleted 33, 000+ emails from her private server, many of them probably related to government business and also smashed phones and hard drives that also in all likelihood had the same information and lied about it under oath, so the people who want to go after Donald J. Trump related to his taxes and yet excuse Hillary Clinton from any legal liability for obstruction of justice are being colossal hypocrites. You clearly are very well-informed on many issues, however, on others you are way off-base.
